FamilyKeeps Terms of Use

FamilyKeeps provides tools for families to build a private family tree, share stories, photos, and videos, and preserve memories across generations. Each new family account creates a unique Family Tree ID to organize profiles and content within that family.

• Family Accounts (18+ only): Only individuals who are 18 years of age or older may create a new FamilyKeeps account and start a new family tree. When you create an account, you also create your personal user profile and a unique Family Tree ID is assigned to your family.
• Profiles vs. Accounts: Account holders may create profiles on the family tree for other family members (including children and deceased relatives). A profile is not an active account unless and until that individual accepts an invitation and creates their own login credentials.
• Children Under 13 (no accounts): Children under 13 are not permitted to create or use FamilyKeeps accounts. Parents or legal guardians may create profiles for children under 13 so they appear on the family tree, but those profiles remain fully controlled by the parent/legal guardian and cannot be used to log in.
• Children Ages 13–17 (invitation by parent/guardian only): Only a parent or legal guardian may invite their own child aged 13–17 to join FamilyKeeps and take control of their profile by creating an account. By sending such an invitation, the parent/legal guardian provides consent for the child’s use of the Services and remains responsible for the child’s activity until the child turns 18.
• Transfer of Control at 13+: When a child accepts an invitation and creates an account, control of the profile transfers from the parent/legal guardian to the child’s account, though the parent/legal guardian continues to be responsible for the child’s use of the Services until age 18.
• Prohibited Invitations: No user may create, manage, or invite someone else’s child (a minor for whom they are not the parent or legal guardian). We may suspend or delete accounts created in violation of this rule.
• Placeholder Entries by Non-Guardians: FamilyKeeps allows family members to add limited “placeholder” entries (e.g., name and relationship) for living minors to visually complete the family tree. Placeholder entries created by non-guardians remain inactive and may not include photos, videos, contact information, or other sensitive data until a parent/legal guardian claims and manages the profile.
• Deceased Family Members: Any family member may create and manage memorial profiles for deceased relatives, including children, for the purpose of preserving family history and memories.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information and to promptly update it as necessary. You will obtain all necessary permissions before uploading content about others (including minors).

You retain ownership of photos, videos, comments, stories, and other content you submit (“User Content”). You grant FamilyKeeps a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce (for backup and technical operations), display, and share your User Content within your selected FamilyKeeps circles and settings for the purpose of operating and improving the Services. This license ends when your content is deleted from our active systems, subject to reasonable backup, archival, or legal retention.

You are solely responsible for your User Content and must ensure you have all rights and permissions needed for its use on FamilyKeeps. We may remove or restrict content that violates these Terms or applicable law.

You agree not to post or share content that is unlawful, harmful, harassing, defamatory, obscene, exploitative, sexually explicit, or otherwise inappropriate; that infringes intellectual property or privacy rights; or that contains malware or spam. You agree not to attempt to access accounts or data without authorization, not to scrape or harvest data, and not to use the Services for commercial advertising without our prior written consent.

We may monitor activity to protect our users and the integrity of the Services. We may remove content, restrict features, suspend, or terminate accounts where we believe these Terms or applicable laws are violated, particularly where the safety of children is implicated. The Services, including software, designs, and trademarks, are owned by FamilyKeeps or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted, no rights are transferred to you.

If you believe content on FamilyKeeps infringes your copyright, send a DMCA notice to: [Insert Agent Name], Attn: DMCA Agent, [Insert Address], [Insert Email]. Your notice must include: (1) your contact information; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and its location; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that the information is accurate and you are authorized; and (6) your physical or electronic signature.

The Services may link to or rely on third-party services (e.g., app stores, analytics, cloud storage). We are not responsible for third-party services’ content, policies, or practices. Your use of such services is governed by their terms and privacy policies.

When you download our mobile app from Apple or Google, you acknowledge that: (a) these Terms are between you and FamilyKeeps only; (b) the platform provider is not responsible for the app or its content; (c) the platform provider has no obligation to furnish maintenance or support; and (d) you will comply with the applicable platform terms (e.g., Apple App Store or Google Play terms).

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILYKEEPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that content will be preserved without loss.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILYKEEPS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FAMILYKEEPS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

You agree to defend, indemnify, and hold harmless FamilyKeeps and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of [Insert State/Country], excluding conflict-of-laws rules. Except where prohibited by law, any dispute arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action. Venue for any permitted court proceedings will lie exclusively in the state or federal courts located in [Insert Venue], and you consent to personal jurisdiction there.

We may modify the Services and these Terms from time to time. If we make material changes, we will provide notice (e.g., via the app or email). Your continued use after changes take effect constitutes acceptance of the updated Terms.
